1. Introduction
These Terms of Service ("Terms") govern your access to and use of the ScholarMe website, web application, and related services (collectively, the "Platform"), operated by Win At Exams Ltd, trading as ScholarMe ("ScholarMe", "we", "us" or "our").
By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. About ScholarMe
ScholarMe is an AI-supported educational platform designed to help learners understand their strengths, identify areas for improvement, receive personalised topic recommendations, and reflect on engagement and progress. ScholarMe is a supplementary learning tool and does not replace formal teaching, tutoring, or assessment.
3. Eligibility and Accounts
ScholarMe is for learners aged 8 to 16. You must be at least 8 years old to use ScholarMe. If you are under 13, your account must be created by a parent or guardian who records consent. If you are 13 to 17, you may create an account, and a parent, guardian, or authorised organisation must supervise it. Accounts for children under 8 are not allowed.
If you are under 18 and linked to a parent account, you may ask to unlink. The link stays until your parent confirms or declines that request.
You are responsible for:
Providing accurate and up-to-date information
Keeping your login credentials secure
All activity carried out under your account
You must not share your account credentials or allow unauthorised access
4. Acceptable Use
You agree to use ScholarMe only for lawful, educational purposes. You must not:
Misuse the Platform or attempt to gain unauthorised access
Reverse engineer, decompile, disassemble, or otherwise attempt to extract or discover the source code, models, algorithms, or underlying logic of the Platform
Copy, scrape, reproduce, or exploit any part of the Platform beyond its intended use
Upload or submit harmful, misleading, or unlawful content
Use the Platform in a way that interferes with its operation or security
Use ScholarMe to develop, train, or benchmark competing products or services
We reserve the right to suspend or terminate accounts that breach these Terms
5. AI Functionality and Educational Disclaimer
ScholarMe uses artificial intelligence to generate learning insights, topic recommendations, and feedback based on user inputs and interactions.
AI outputs:
Are generated algorithmically
May contain inaccuracies or limitations
Are provided for educational guidance only
Should not be relied upon as definitive academic advice or assessment
Users remain responsible for their own learning decisions and outcomes.
6. Intellectual Property
All intellectual property rights in the Platform, including software, models, algorithms, content, design, and branding, are owned by or licensed to ScholarMe.
You are granted a limited, non-exclusive, non-transferable licence to use the Platform for personal, non-commercial educational purposes only.
You must not copy, reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written consent.
7. User Content
You retain ownership of any content you submit to ScholarMe ("User Content").
By submitting User Content, you grant ScholarMe a non-exclusive, royalty-free licence to use, store, and process that content solely for the purpose of providing and improving the Platform.
You confirm that you have the right to submit such content and that it does not infringe third-party rights or applicable laws.
8. Payments and Subscriptions
ScholarMe offers both free and paid tiers of access. The free tier provides access to core features, while paid subscriptions unlock additional functionality and enhanced features. Details of feature availability for each tier will be displayed on the Platform.
8.1 Billing
Paid subscriptions are charged in advance on a recurring basis, unless stated otherwise.
Payments are processed via third-party payment provider.
You authorise us to charge the applicable fees to your selected payment method.
8.2 Changes, Upgrades, and Cancellation
You may upgrade, downgrade, or cancel your subscription at any time through your account settings.
Changes to your plan will take effect as described at the point of change.
Cancellation will take effect at the end of the current billing period.
We do not provide partial refunds for unused portions of a billing period, unless required by law.
8.3 Price and Feature Changes
We may change subscription fees or the features included within free or paid tiers from time to time. Any material changes will be communicated in advance and will apply from the next billing cycle where applicable.
9. Suspension and Termination
We may suspend or terminate access to the Platform immediately if:
These Terms are breached.
Use of the Platform poses a security or legal risk.
Required payments (if applicable) are not made.
Upon termination, your right to use the Platform will cease.
10. Limitation of Liability
To the fullest extent permitted by law:
ScholarMe is provided on an "as is" basis.
We do not guarantee learning outcomes, academic results, or accuracy of AI outputs.
We are not liable for indirect, incidental, or consequential losses arising from use of the Platform.
